Biography

Bridget Fahey is an Assistant Professor at the University of Chicago Law School, where she also serves as the Faculty Co-Director for Data Ecology. Her academic focus lies in constitutional law, emphasizing theories and practices within American federalism. Particularly, she explores how domestic governments interact in unexpected ways and employ unorthodox legal tools in managing joint projects. Fahey's forthcoming co-authored article, "Layered Constitutionalism: Structural Interdependency," published in the Columbia Law Review, theorizes a largely hidden body of federal constitutional rules that shape state structural choices. She is also interested in the stewardship of government-held private data. Her project, "Building Data Federalism," is a cross-disciplinary initiative funded by the Neubauer Collegium aimed at understanding the legal-technical architectures that govern the flow of data among domestic governments. Prior to joining academia, Fahey was a litigator in the Washington DC office of WilmerHale, and held a fellowship at the University of Pennsylvania Law School. She also clerked for Justice Sonia Sotomayor on the Supreme Court and worked as a management consultant for the Boston Consulting Group in Chicago and Berlin. At the University of Chicago, Fahey teaches first-year Contracts and Constitutional Law, coordinates the Public Law Workshop, and has taught a range of Greenberg Seminars on topics such as Space Law and Free Speech on Campus.
