Dr. David Schwartz

Biography

Professor David S. Schwartz teaches and writes in the areas of Constitutional Law, Evidence, and Civil Procedure. His scholarship includes articles published in prestigious journals such as the Georgetown, Notre Dame, and University of Pennsylvania law reviews. He is the co-author of casebooks including 'Constitutional Law: Context and Practice Casebook' (Carolina Academic Press, 3rd ed. 2021) and 'Analytical Approach to Evidence: Text, Problems, and Cases' (Wolters Kluwer, 7th ed. 2021). His book, 'The Spirit of the Constitution: John Marshall's 200-Year Odyssey to McCulloch v. Maryland', published by Oxford University Press in September 2019, reflects his insights into constitutional interpretation. Currently, he is working on a book project titled 'Myth of Enumeration: Federal Power and the Failure of Originalism' (forthcoming Oxford University Press). He is the founding editor and Editor-in-Chief of the Journal of American Constitutional History. In 2023, he was awarded the Vilas Distinguished Achievement Professorship at the University of Wisconsin. Schwartz has received the Law School's Classroom Teacher of the Year Award multiple times and has provided significant public service, including drafting amicus curiae briefs for employee consumer rights issues before the U.S. Supreme Court and various state supreme courts. He is also involved with the Wisconsin Judicial Counsel project to revise the Wisconsin Evidence Code.
