Biography

Elana R. Fogel is an Associate Clinical Professor at Duke University School of Law and the inaugural director of the Criminal Defense Clinic. She joined the Duke Law faculty in 2022 after serving as a trial attorney with the Federal Defenders of San Diego, where she represented indigent persons accused of criminal offenses in federal court. Fogel has practiced law at both state and federal levels and has a rich background in advocacy. Before joining the Federal Defenders in 2017, she was a post-graduate fellow at Harvard's Criminal Justice Policy Program, where she focused on oversight and transparency in the use of emerging science and technologies in policing and data-driven approaches to combating mass incarceration. She also served as a public defender with the Committee for Public Counsel Services in Boston. Fogel earned her bachelor's degree in Politics from New York University, where she was a member of the women's basketball team and an academic team honoree. She received her Juris Doctor from NYU School of Law, where she was a Root-Tilden-Kern Lindemann Family Public Service Scholar, working with the Bronx Defenders and the American Civil Liberties Union's Initiative to Combat Mass Incarceration.
