Biography

Frankie McCarthy was appointed Professor of Private Law in 2019, having been a member of the School as a PhD researcher and lecturer since 2007. He is a graduate of the Universities of Edinburgh (LLB, Diploma in Legal Practice) and Glasgow (PhD), and is a qualified solicitor. Professor McCarthy is set to join the Scottish Law Commission on a full-time basis in October 2024. He is currently teaching and handling administrative duties at the University. His research interests focus on property law and family law, particularly the intersections with human rights, and he is especially interested in the development of property as a human right in Europe. His work addresses the protection of property ownership as a civil right and the extent to which property rights impose responsibilities. He has explored theories of property rights, with a specific interest in progressive property scholarship that aims to reconceptualize property ownership in light of community interests in land, particularly in the context of Scotland's land reform agenda. His research also examines family property issues, particularly the financial rights of non-marital cohabiting couples during relationship breakdown.
